General Terms and Conditions (GTC)

These GTC apply to all transactions concluded via the online shop osina.ch. Osina.ch reserves the right to amend these GTC at any time. The version valid at the time of the order shall apply.

1. Products, Prices and Order Quantity

Images in the online shop are for illustration purposes only and are non-binding. All prices include statutory VAT. Osina.ch reserves the right to change prices at any time — the price at the time of ordering is binding. There is no minimum order quantity.

2. Availability and Delivery Times

Osina.ch endeavours to keep product availability up to date at all times. Delivery time is generally 2–4 working days. All availability and delivery time information is non-binding.

3. Contract Formation

The purchase contract is concluded when the customer places an order via the online shop, by email or by phone. The automatically generated order confirmation by email merely confirms receipt of the order and does not guarantee product availability.

4. Delivery

Delivery is carried out by Planzer Parcel Service within Switzerland. The delivery address must be located in Switzerland. Planzer is liable for lost shipments. In such cases, the customer must contact Planzer directly. Shipping costs are listed separately.

5. Inspection Obligation

Incorrect or incomplete deliveries must be reported to info@osina.ch within 5 calendar days of receipt. Incorrectly delivered products must be returned in their original condition. Return shipping costs will be reimbursed.

6. Payment

Payments must be made exclusively in Swiss francs (CHF). Available payment methods are listed in the online shop under "Payment Methods". Credit card payments are charged at the time of ordering. For bank transfer (prepayment), delivery takes place only after receipt of payment.

7. Payment Default

If the customer fails to meet payment obligations, all outstanding amounts become immediately due upon the first reminder. A reminder fee of CHF 40.00 will be charged with the first reminder. If reminders are unsuccessful, claims may be assigned to a debt collection agency. An effective annual interest rate of up to 15% on the outstanding amount may additionally apply.

8. Retention of Title

Delivered products remain the property of Osina.ch until payment is received in full.

9. Cancellation

Orders are binding for the customer. If delivery is not possible after contract formation, the customer will be informed promptly and payments already made will be refunded. Further claims due to delay or failure to deliver are excluded.

10. Return of Defective Goods

Damaged or defective goods will be replaced in agreement with Osina.ch. Goods may be returned by post or, by prior telephone arrangement, delivered in person to the Winterthur location.

11. Right of Withdrawal

Customers resident in Switzerland have no statutory right of withdrawal. For customers resident in the EU, EU distance selling law applies. EU dispute resolution: https://ec.europa.eu/consumers/odr. Osina.ch does not participate in consumer dispute resolution proceedings.

13. Data Protection

The privacy policy is an integral part of these GTC and is available at osina.ch.

14. Severability Clause

Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid one that comes as close as possible to the economic purpose of the invalid provision.

15. Jurisdiction and Applicable Law

Swiss substantive law applies exclusively. The place of jurisdiction for all disputes is Winterthur.

12. Youth Protection

The protection of children and young people is important to us. Statutory age restrictions apply to certain products and are strictly enforced.

By completing the order, the customer expressly confirms having reached the legally required minimum age. Osina.ch reserves the right to carry out age checks. If the minimum age cannot be verified, delivery will be refused.
