1. scope of application

The General Terms and Conditions (hereinafter referred to as "GTC") apply to all legal transactions concluded via the online shop "www.osina.ch". Osina.ch reserves the right to change these GTC at any time. The version of these terms and conditions valid at the time of the order is decisive.

2. products, prices and order quantity

The images of the products in the online shop are for illustration purposes and are not binding. All sales prices published in the online shop are prices that include VAT. Osina.ch reserves the right to change the prices of the products offered at any time. Decisive for the conclusion of the sales contract is the price in the online shop at the time of the order. There is no minimum order quantity.

3. availability and delivery time

Osina.ch attaches great importance to indicating the availability of products in the online shop in an up-to-date manner. The delivery time is 2-3 working days regardless of the order volume. Information about availability and delivery time are without guarantee and can change.

4. conclusion of contract

The purchase contract is concluded as soon as the customer places an order in the online shop, by e-mail or by telephone. The arrival of an online order is confirmed to the customer by means of an automatically generated order confirmation from Osina.ch to the e-mail address provided by the customer. The receipt of the automatically generated order confirmation does not contain a promise that the product can actually be delivered. It merely indicates to the customer that the order has been received by Osina.ch.

5. delivery

The delivery of the ordered goods is carried out by the Swiss Postal Service within Switzerland and Liechtenstein. The delivery address of the customer must therefore be in Switzerland or Liechtenstein. The Swiss Post is liable for lost parcels. In this case the customer must contact Swiss Post directly. Detailed information on delivery prices is listed separately and can be adjusted at any time.

6. obligation to check

Incorrect or incomplete deliveries must be reported to Osina.ch by e-mail or telephone within 5 calendar days from the date of delivery. The customer has to return the wrongly delivered articles to Osina.ch as received. The resulting costs will be reimbursed to the customer.

7. payment

All claims for payment of products purchased at Osina.ch are made directly by Osina.ch to the customer. Payments must be made in Swiss francs. The customer has the payment options offered as a means of payment in the online shop under "Payment options". If payment is made by credit card, the amount will be charged when the order is placed. If payment is made in advance, delivery will only be made after receipt of payment.

8. default of payment

If the customer does not meet its payment obligations in whole or in part, all outstanding amounts are due immediately after the first reminder. With the first reminder 80 Swiss francs reminder fees will be charged. In this case, Osina.ch can stop further deliveries of products to the customer. In the case of unsuccessful reminders, the invoice amounts will be assigned to a company commissioned with the collection. In this case, an additional effective annual interest of up to 15% on the invoice amount owed from the due date can be charged. The company entrusted with the collection will claim the outstanding amounts in its own name and on its own account and may charge additional processing fees.

9. retention of title

Ordered products remain the property of Osina.ch until full payment has been received

10. change or cancellation of the order

Orders oblige the customer to accept the products. If a delivery impossibility occurs after an order has been placed or a contract has been concluded in accordance with section 4, the customer will be informed immediately by e-mail. If the customer has already paid, this amount will be refunded. If payment has not yet been made, the customer is released from the obligation to pay. Further claims due to delay in delivery or failure of delivery are excluded.

11. return of defective goods Damaged goods will be replaced immediately after consultation with Osina.ch. The damaged goods must be returned to Osina.ch by mail or can be brought personally to the headquarters of Osina.ch by telephone arrangement.

12. Data protection The privacy policy is an integral part of these terms and conditions.

13. severability clause

Should any provision of this contract be or become invalid, the validity of the contract as a whole shall not be affected. The contracting parties shall replace the invalid provision by a valid provision which comes as close as possible to the intended economic purpose of the invalid provision. The same shall also apply to any contractual loopholes.

14 Jurisdiction and applicable law All legal relations between Osina.ch and the customer are subject to Swiss substantive law.

The place of jurisdiction is Winterthur.
